Is surcharging legal in Illinois?

✅ Is surcharging legal in Illinois?

Yes. Illinois is one of the “remaining 35 states” where merchants can surcharge credit‑card transactions without violating state law.

There are no Illinois‑specific caps, no special disclosure rules, and no state‑level bans.

📌 Rules you must follow in Illinois

Even though Illinois doesn’t add extra restrictions, you still must comply with:

Federal law

  • Maximum surcharge: 4%
  • Debit‑card surcharges: illegal nationwide
  • Prepaid‑card surcharges: also prohibited

Visa/Mastercard rules

  • Surcharge cannot exceed your actual processing cost (Visa often limits to 3%, even though federal law allows 4%)
  • Must notify Visa/Mastercard 30 days before starting surcharging
  • Must disclose surcharge:
    • At the store entrance
    • At the point of sale
    • On the receipt

POS requirements

  • Surcharge must be applied only to credit, never debit
  • Must be a percentage, not a flat fee
  • Must be consistent across all credit cards of the same brand

Is It Legal to Surcharge Credit Cards? (The Quick Answer)

Credit Card Surcharge Laws by State (Updated For 2026)

In most cases, yes—it’s legal to surcharge credit cards. According to federal law, there’s a 4% maximum allowable surcharge on credit card transactions. Debit card surcharging is illegal in all 50 states.

With that said, it’s illegal to surcharge credit card transactions in:

  • Connecticut
  • Maine
  • Massachusetts

Other states have laws that allow surcharging but with some contingencies.

  • California bans surcharges as separate line items but permits dual pricing and all-in pricing (restaurants are excluded from this ban).
  • Colorado allows credit card surcharging up to 2%.
  • New York, New Jersey, Nevada, South Dakota, Nebraska, and Georgia prohibit surcharges from exceeding the cost that the merchant pays to accept the card.
  • Georgia also allows convenience fees on credit card transactions, but only if the merchant accepts alternative types of payments.
  • Texas law prohibits surcharging but allows merchants to impose convenience fees, service fees, and cash discounts (federal courts have ruled against Texas surcharge laws).
  • Kansas also has anti-surcharging laws that were overturned by federal courts, but merchants must include the credit card fees in the listed price to legally impose a surcharge.
  • Minnesota allows credit card surcharging, but requires mandatory fees to be included in the advertised price of a purchase unless the fees can be reasonably avoided by the consumer.
  • Wyoming allows merchants to surcharge credit cards but caps cash discounts at 5% (the only state in the country that does this).

Merchants in the remaining 35 states can likely surcharge credit card transactions without breaking the law. But again, make sure to consult with an attorney and verify this information with your state to ensure you’re in compliance.

How to Increase Print Darkness on PAX S80

To make your PAX S80 print darker, you need to adjust the thermal printer density. The S80 doesn’t label it as “darkness,” but the setting is inside the Receipt Print menu under Operation Settings. This is confirmed by the same menu path used for font and receipt adjustments on the S80 faq.paysafe.com vizypay.zendesk.com.

✅ How to Increase Print Darkness on PAX S80

Follow this exact path on the terminal:

  1. Press MENU
  2. Select OPERATION SETTINGS
  3. Select RECEIPT PRINT
  4. Enter the password (usually 1234, 123456, or provided by processor)
  5. Look for:
    • Print Density
    • Darkness
    • Print Contrast
    • Thermal Settings
  6. Increase the value by one step at a time
(Too high = smudging or overheating)

If your S80 software version doesn’t show “Density,” it may be under FONT SIZE or RECEIPT PRINT sub‑options depending on processor firmware.

🔧 If the print is still too light

Try these additional fixes:

1. Flip the thermal paper roll

Thermal paper only prints on one side.
Scratch the paper with your fingernail — the side that marks is the correct side.

2. Use higher‑quality thermal paper

Cheap paper prints lighter and fades quickly.

3. Clean the print head

Use 70%+ isopropyl alcohol on a lint‑free swab.
A dirty head = weak printing.

4. Reboot the terminal

Hold the power button → restart.

Want me to walk you through the exact menu based on your firmware version?

If you can tell me what options you see under RECEIPT PRINT, I’ll pinpoint the exact setting.
